As you know, our law firm handles all types of injury cases including accidents, medical malpractice, product liability, and wrongful death.

The reason for this message is to alert you we are currently handling product liability claims which involve metal on metal hip implants (MoM) and a fast approaching potential statute of limitations.

People with MoM hip implants, according to research, have a higher risk of elevated chromium and cobalt levels. There is also a higher risk of developing metallosis. In layman's terms, the metal parts of these artificial parts grind against other metal parts and microscopic particles enter their system only to be attacked by the body's immune system.

On June 1, 2012, Smith Nephew recalled a metal liner that was often used in conjunction with metal implants. On July 6, 2012, Stryker Orthopaedics recalled two of their MoM hip systems. As a result of these recall dates, time is of the essence!

If you or anyone you know had a total hip replacement, and if you/they suffered hip pain, swelling, dislocation, problems walking, bone fracture, implant loosening, or fluid around the implant, please respond or alert them to the seriousness of this recall and the short time frame in which to act.

Our office is currently screening numerous potential claims for MoM implant patients. We would welcome the opportunity to review any potential case you may have. However, we can not emphasize enough the importance of acting quickly as potential deadlines are approaching as early as June 1, 2013 for some cases.

Please call me or my Legal Assistant, Gayle Gowen, to discuss this further or schedule an appointment.

The CDC in Atlanta has activated their Emergency Operations Center and is currently at level 2 (level 1 is the highest) due to the H7N9 avian flu outbreak in China. This activation allows for additional resources and staff to meet the needs of a public health response. To put this into perspective, the last time the EOC was activated was for Japan's tsunami in 2011.

Meanwhile, in China the death toll from H7N9 has risen to 22. There have been 108 reported cases of the virus. The World Health Organization says "This is an unusually dangerous virus for humans." The concern is that this virus is more easily transmitted from poultry to humans than H5N1. That virus claimed over 300 lives between 2004 and 2007.

H7N9 has started to spread through various regions of China, and now has crossed the border for the first time, with a reported case in Taiwan.

MTD, a maker of lawn and garden equipment, has announced that they plan to add 225 positions to their work force in Martin. Good news for West Tennessee, but it is the result of bad news being delivered to workers in Streetsboro Ohio. The company is shuttering its facility there in June, which created the new job opportunities in Martin. The new jobs won't open right away in Martin. According to news reports the 225 will be added over a 5 year period, with the first 150 after the facility's expansion is completed in November. Pay is expected to be in the $13 to $15 per hour range. MTD has not said when or how interested people can apply.

Tennessee Governor Bill Haslam said in a news release "I want to thank MTD Consumer Group for their investment in Tennessee." Martin Mayor Randy Brundige mirrored those remarks, adding "We are elated with MTD's announcement of expansion...here in Martin."

MTD continues to maintain their facility in Martin, but in 2009 they closed their plant in Haywood County, resulting in the loss of 200 jobs.

Jackson made the top 10 as one of the best metro areas (population less than 200,000) in the nation!  Site Selection magazine ranked Jackson at #7, based on industrial investment and growth. The magazine says that in order to be included in the database, a project must have a capital investment of more than $1 million add at least 20,000 square feet of new space, and create 50 or more new jobs. Jackson had 9 such projects in 2012. According to the report, Jackson added 528 new industrial jobs with existing companies. Mayor Jerry Gist said, "We can attribute this ranking to a strong year in all of our industries. These industries chose to grow here and made large contributions to our community."

The death of a 21 year old reality TV cast member has focused light on the often overlooked dangers of carbon monoxide poisoning.

MTV's Buckwild is a reality show based on the lives of a young Real World/Jersey Shore type of group in rural West Virginia. The cable channel has decided to cancel the show after Shain Gandee died along with his uncle and a family friend. The three men were going 'mudding' in Gandee's Bronco the night of March 31st and the vehicle stuck in the mud. Investigators have determined that the exhaust pipe was submerged and the carbon monoxide laced exhaust fumes filled the cabin of the truck resulting in the accidental death of all three men. They were discovered by an acquaintance the next day. The show's film crews were not present at the time of the incident.

The headlines of this story underscore the dangers of carbon monoxide poisoning which can lead to death, but most often results in illness which frequently requires hospitalization. Carbon monoxide poisoning can occur in homes, apartments, at work, in school, or even in hotels.

When carbon monoxide poisoning is caused by the negligence of landlords or property owners, builders, appliance manufacturers, or even repair & maintenance companies, the victims or victims' families may be entitled to compensation.

The law offices of T. Verner Smith offer a free consultation for potential plaintiffs in poisoning lawsuits of all kinds, including carbon monoxide poisoning. If you or a loved one has been the victim of carbon monoxide poisoning that may have been prevented by another person or company's reasonable care, you should contact us right away. All cases are reviewed on a contingency fee basis, meaning that there are no fees or expenses unless we obtain a recovery for you.

You may want to hold off on ordering a roast beef sandwich from a retail shop for the next few days.  A Louisiana meat-packing company has recalled 20,166 pounds of potentially bacteria-tainted cooked roast beef deli meat in various states across the nation.

The possibly tainted products were packed Feb. 27 and shipped for distribution and to retail deli stores in Illinois, Louisiana, Mississippi, Texas, Florida, Alabama, Oklahoma and Tennessee. This product may also be available at grocery stores featuring fresh deli sections.

The U.S. Department of Agriculture's Food Safety and Inspection Service said Wednesday that Manda Packing Co., based in Baker, is recalling the meat that may be contaminated with Listeria monocytogenes. Food contaminated with the bacterium can cause listeriosis, an uncommon but potentially fatal disease. FSIS was alerted to the problem by the Tennessee Department of Health, who took an intact sample of cooked roast beef at a retail establishment on April 5, 2013, which later confirmed positive for Listeria monocytogenes.

The recall includes Manda Supreme Roast Beef, Four Star Cajun Roast Beef, Four Star Roast Beef, Cajun Prize Roast Beef, Manda Supreme Natural Roast Beef, Manda Natural Roast Beef, Manda New Orleans Style Roast Beef and Manda Whole Wet Pack Roast Beef.

Each package has a "Sell by" date of May 13, 2013, and bears the establishment number "EST. 8746A" inside the USDA mark of inspection. Officials say the company has not received any reports of illnesses associated with the products.

If you get food poisoning from a restaurant, catering, or other event in which the food preparer is obligated to prepare and present a safe product, you may be entitled to damages as a result of your illness. While food poisoning is a potentially serious illness, it is also difficult to prove because oftentimes symptoms do not appear immediately, and unless a number of individuals are made sick it is difficult to prove the originator is at fault. Timing is also critical. You should contact us immediately if you suspect you have a case in order for our office to obtain important information in order to prove fault.

Anytime there is a chance of severe weather, everyone seems to run to the grocery store. Not a bad idea, but at least have some general idea of what to get----storms of the past in West Tennessee have taught us that with the possibility of a tornado or even floods---there is always a chance you'll need to get by without electricity for a few days. When your refrigerator gets above 40 degrees, most of the items inside can be dangerous to eat. The same applies with frozen food, after it gets above 40 degrees you can't re-freeze it. So although this link is to a 'hurricane' grocery list, most all of the same suggestions apply to our area if we are without electricity due to storms, a tornado, or flood.

To see the latest weather watches and warnings as they are issued, bookmark the Tennessee alerts page here. It is updated automatically every 2 to 3 minutes and shows any new alert, watch or warning issued in Tennessee. You should also bookmark the National Alert Map page here so you can track systems before they get to Tennessee.

An online radar map we really like is this one from wunderground. It gives you several options to customize it for your own needs & interests, it updates very quickly and is very accurate. They also have an even more elaborate and detailed radar if you're really wanting to dig into lots of options, that one is here

Visit this page on the Weather Channel's siteIt is filled with several videos covering everything from: the safest place to be during a tornado, how to deal with storm stress, car or ditch, high wind dangers, and a tornado preparedness checklist, among others. Great, short, and informative videos for you and the entire family to watch.

A great phone app is free from the Red Cross, you can learn more about the iphone and Andoid app here. It has several features, including alerts, checklists, and even an 'I'm safe' alert you can send to your family & friends.

For the kids, how about a 6 page coloring book you can print, covering tornado safety tips? You can download the pdf here, print it and have the kids color and learn at the same time. There is even a quiz at the end to be sure they know what they need to know!
