Talcum powder cause of ovarian cancer case moves forward despite Johnson & Johnson court attempt

A U.S. District Judge has denied a motion to dismiss conspiracy claims against defendants Johnson & Johnson and Imerys Talc America, Inc., fka Luzenac America, Inc.

 

This ruling is regarding a lawsuit filed by Michael Blaes as the result of the death of his wife Shawn Blaes. She died of ovarian cancer allegedly caused by the use of Johnson & Johnson Baby Powder and Shower to Shower, specifically in the genital area. The products contained talc mined and sold by Imerys. The plaintiff alleges, among other claims, that the defendants conspired to perform wrongful acts to misrepresent and suppress the truth regarding the danger associated with using talcum powder in the genital area by doing the following:

 

  • They released false information about the safety of talc to consumers and used political and economic influence on the regulatory groups of talc.

  • They created the TIPTF (Talc Interested Party Task Force) which pooled resources to defend talc use at all costs and prevent regulation through the use of biased research and scientific reports via their funding and influence.

 

The plaintiff is claiming that this was an effort to illegal prevent consumers from learning of the potential harmful effects of talc use. 

 

The case now moves to the discovery phase with a trial date of March 7, 2016.
