Injury from cracked sidewalk results in $1.25 million payout

October 20, 2019

A man who suffered injuries after his bicycle came into contact with a cracked city sidewalk will get $1.25 million as a result.

In November of 2016, Van Nguyen crashed his bicycle in San Diego California after the front wheel slammed into a cracked sidewalk. He filed suit in 2017, and earlier this month, the San Diego City Council approved the payout.  Nguyen claimed in his suit that he suffered cranial nerve damage, dental injuries and facial injuries as a result of the accident and it prevented him from working. The lawsuit stated that the sidewalk was cracked and uplifted by tree roots, which caused the plaintiff to be thrown from his bicycle and violently impact the pavement.

City officials have considered accelerating their efforts to fix thousands of damaged sidewalks across the city, with an estimated cost of those repairs approaching $40 million.
